Terms of Service

These Terms of Service ("Terms") govern your access to and use of GPS Spartan (the "Service"), operated by Spartan Media LLC ("we", "us", or "the Company"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account, making a purchase, or using the Service in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity.

2. Service Description

GPS Spartan provides a GPS tracking and fleet management platform that includes:

• Real-time vehicle tracking via GPS devices
• Daily trip reports with business vs. personal classification
• Mileage reports for IRS tax deductions
• Driver management and vehicle assignment
• Driver behavior scoring
• Remote GPS device configuration via SMS

3. Account Registration and Responsibilities

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must promptly notify us of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms or provide false information.

4. Pricing and Billing

Current pricing for the Service is as follows:

• GPS Device: $25.00 per device (one-time payment)
• Monthly Plan: $14.99 per device per month
• Annual Plan: $179.88 per device per year (pay 12 months, get 15 months of service — 3 months free)

All payments are processed securely through Stripe. Prices are subject to change with 30 days prior notice. Subscription charges are billed automatically at the start of each billing cycle.

5. Cancellation and Refunds

You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing cycle. No refunds are issued for partial subscription periods. GPS devices are final sale and non-refundable once shipped. If you experience a technical issue with a device, contact us for assistance or replacement.

6. Acceptable Use

By using our Service, you agree that:

• You will only track vehicles that you own or for which you have written legal authorization from the owner
• You will not use the Service for illegal surveillance, stalking, harassment, or any purpose that violates applicable laws
• You will comply with all applicable federal, state, and local laws regarding GPS tracking device usage
• You will not attempt to reverse engineer, decompile, or compromise the security of the Service
• You will not resell, sublicense, or redistribute the Service without our written consent

7. Intellectual Property

All content, features, and functionality of the Service, including but not limited to software, text, graphics, logos, icons, and design, are owned by Spartan Media LLC and are protected by United States and international copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

8. Limitation of Liability

To the maximum extent permitted by law, Spartan Media LLC, its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, resulting from: (a) your use or inability to use the Service; (b) inaccurate or incomplete GPS tracking data; (c) mileage calculations for IRS purposes; or (d) any unauthorized access to your data. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure. Mileage and trip data is provided as a reference and does not constitute professional tax advice. Please consult with a qualified tax professional for guidance on IRS deductions.

10. Indemnification

You agree to indemnify, defend, and hold harmless Spartan Media LLC and its directors, employees, and agents from any claims, damages, obligations, losses, liabilities, and expenses (including attorney fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any law or third-party rights; or (d) unauthorized use of GPS tracking devices.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions. Any legal dispute arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in North Carolina.

We may suspend or terminate your access to the Service immediately, without prior notice, if: (a) you violate these Terms; (b) you fail to pay fees owed; (c) you engage in fraudulent or illegal activities; or (d) your use poses a security risk. Upon termination, your right to use the Service will cease immediately. You may terminate your account at any time by contacting us or canceling your subscription.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will post updated terms on this page with a revised "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified terms, you should discontinue use of the Service.
